DESCRIPTION:Overview:  \nThe Personal Data Protection (Amendment) Act 2024 (PDPA 2024) in Malaysia\, which was published in the Gazette on 17 October 2024\, marks significant changes to Malaysia’s data protection framework. The significant amendments include mandatory data protection officer (DPO) appointment by controllers and processors\, mandatory data breach notifications\, data portability rights and requirements under the security principle. The PDPA 2024 also amends the rules relating to data transfers and increases penalties for non-compliance. These amendments to the current Personal Data Protection Act 2010 (PDPA 2010) aims to modernize the law\, aligning more closely with  internationally recognized standards\, positioning Malaysia alongside its regional peers in Asia-Pacific\, addressing the evolving challenges of data protection in the digital age. DESCRIPTION:Introduction:\nThe occupational noise-related hearing disorder has recorded alarming statistics as major contributor to total cases of occupational diseases. According to National Occupational Accident and Disease Statistics 2021 by Department of Statistics Malaysia\, occupational noise-related hearing disorder reported 3\,648 cases out of total 5\,289 cases in Occupational Disease and Poisoning Statistics 2021*. In further updates reported by The Star on 11 August 2022\, in the first five months of 2022\, out of the total 2\,042 cases occupational disease reported\, 1\,273 cases (62.3%) were occupational noise-induced hearing loss\, while in year 2019\, 5\,699 cases were confirmed as occupational noise-related hearing disorders**. The Industry Code of Practice for Management of Occupational Noise Exposure and Hearing Conservation 2019 provides guidelines to assist all stakeholders in managing cases of occupational noise-related hearing disorder in the aspects of monitoring and enforcement\, reporting\, compensation claiming\, reduction and prevention of occupational noise induced hearing loss. \nSafety data analytics transform enormous data in the form of inspection reports\, incident reports\, sickness records\, risk assessments\, environmental readings\, safety behaviors indicators etc. into predictive models for predicting future safety risks based on present work patterns and is beneficial for assessing risk factors. The scope includes assigning the responsibility to upkeep a first aid box or cupboard to a responsible person\, and for a factory with more than 20 person employed\, specifying that the responsible person should be proficient in first aid treatment. \n  \nThe Occupational Safety and Health Act 1994 \nSection 15(1) of the Occupational Safety and Health Act 1994 (Act 514) provides that every employer and the self-employed person must ensure\, so far as is practicable\, the safety\, health and welfare at work of all his employees. DESCRIPTION:Introduction:\nWhen a company enters financial distress\, it may signal the impending insolvency and winding up of a company. The company’s secured lender may have a right to also appoint a receiver over the company due to the company’s inability to pay its debts to the secured lender. A company will want to consider its options in attempting to restructure its debts and to revive its business. The corporate rescue mechanisms under the new Companies Act 2016 allow additional options for a company to restructure its debts and to revive its business. The new processes are the corporate voluntary arrangement and judicial management. They complement the schemes of arrangement process. \n  \nObjectives:\nParticipants will learn the improvements made to the insolvency-related laws as set out in the Companies Act 2016. The receivership provisions have been strengthened and will be relevant to secured lenders and to borrowers. The winding up provisions have been modified in certain aspects. A company can undertake a restructuring of its debts through the scheme of arrangement process and the new provisions adds clarity in this area. Finally\, the Companies Act 2016 introduces two new corporate rescue mechanisms: corporate voluntary arrangement and judicial management. Participants will learn how these corporate rescue mechanisms will provide more options to financially distressed companies.
